وفقًا لما ورد في تقرير جديد صدر هذا الأسبوع، 51٪ من صناع  القرار في القطاع القانوني الذين شملهم الاستطلاع يصفون التغييرات المفاجئة التي أدخلت على السياسة التنظيمية في منطقة الشرق الأوسط وشمال إفريقيا بأنها “تحديًا” أو “تحديًا صعبًا”. ويشير التقرير إلى أن هذه التحديات لا تكمن فقط في وتيرة إصدار اللوائح الجديدة بل أيضًا في الوقوف على فحواها ومن ثم إنفاذها.

وقد صدر هذا التقرير المعنون “القادة القانونيون في منطقة الشرق الأوسط وشمال إفريقيا” بتكليف من شركة التميمي ومشاركوه للتحقق والكشف عن الأمور التي تقض مضاجع صناع القرار بالقطاع القانوني، وكذلك المخاطر والأولويات المستجدة التي يواجهها هذا القطاع في المنطقة حيث جمع التقرير آراء 700 من صناع القرار بالقطاع القانوني في 9 دول و 13 قطاعًا صناعيًا على مستوى منطقة الشرق الأوسط وشمال إفريقيا.

ويسلم تقرير القادة القانونيين في منطقة الشرق الأوسط وشمال إفريقيا بأنه إلى جانب التطورات السريعة في البيئة التنظيمية، هناك مبادرات مستمرة لتطوير المنطقة لتصبح وجهة مثالية للأعمال، فيما يبين أن تزايد السياسات التنظيمية الجديدة يمثل تحديًا بالنسبة للشركات في قدرتها على مواكبة التغيير القانوني. وينعكس ذلك من خلال التركيز الذي توليه الشركات لدور صناع القرار بالقطاع القانوني داخل مؤسساتهم، حيث صرح 54٪ من المشاركين أنهم منتسبون إلى عضوية مجلس الإدارة أو يشغلون منصبًا مماثلًا في الشركة. علاوة على ذلك، كشف 90٪ من صناع القرار بالقطاع القانوني المشمولين بالاستطلاع أنهم يقدمون الآن المشورة بشأن الاستراتيجية الخاصة بمؤسساتهم.

ويستعرض هذا التقرير عددًا من المجالات ذات الصلة التي تحتل مكانة عالية في الأجندة القانونية، منها ظهور هياكل الحوكمة البيئية والاجتماعية وحوكمة الشركات (ESG) كما يؤكد على الأهمية المتزايدة لمؤشر الحوكمة (ESG)، حيث يشير التقرير إلى تولي الأغلبية العظمى – 94٪ من صناع القرار بالقطاع القانوني – بصورة منتظمة أو عرضية – تقييم مخاطر الحوكمة البيئية والاجتماعية والمؤسسية والامتثال في نطاق الأدوار الخاصة بهم. ولا غرابة في أنه من المتوقع لدى 80٪ من صناع القرار بالقطاع القانوني  أن تصبح اعتبارات الحوكمة البيئية والاجتماعية والمؤسسية أكثر أهمية لعملهم في السنوات القادمة. ومع انتقال مؤشر الحوكمة (ESG) إلى المجال القانوني والامتثال، يشير التقرير بوضوح إلى الدور الأساسي الذي سيلعبه صناع القرار بالقطاع القانوني في تنفيذ سياسات الـ ESG المستقبلية.

وقال سامر القضاة، الشريك الإداري في شركة التميمي ومشاركوه: “نرحب بالتقدم المحرز على الصعيد التنظيمي في المنطقة. لقد أبرز تقرير القادة القانونيين في منطقة الشرق الأوسط وشمال إفريقيا البيئة سريعة التغير، وتطبيق التكنولوجيات العصرية، وأهمية مؤشر الحوكمة (ESG) كعوامل رئيسية ينبغي للمجتمع القانوني أن يوليها اهتمامًا وثيقًا. فمن جانبنا، سنتابع العمل استناداً إلى هذه المعلومات بالسعي الى توفير التدريب اللازم بصورة منتظمة لتعزيز مهارات الكوادر القانونية لدينا في التعامل مع المشهد القانوني التقدمي في المنطقة. وبذلك ستكون إدارة الشركة مجهزة دومًا لتلبية طلبات العملاء المتزايدة والوفاء بدورنا ومسؤوليتنا كمستشارين قانونيين”.

 وتعليقًا على إطلاق تقرير القادة القانونيين في الشرق الأوسط وشمال إفريقيا لعام 2022، قال عصام التميمي، رئيس مجلس إدارة شركة التميمي ومشاركوه: “إن التغييرات والتحديثات التنظيمية التي يجرى تطبيقها حاليًا إيجابية ومن شأنها تحقيق الامتثال للمعايير الدولية في المنطقة. ومن الواضح أن لدورنا كصناع قرار في القطاع القانوني أهمية متزايدة في ظل هذه التحديات، على ما هو ثابت من تأثيرنا المتزايد  على الاستراتيجية المؤسسية. وبينما نحن نمضي في طريقنا عبر مشهد قانوني سريع التطور، سيلجأ العملاء إلينا طلبًا للإرشادات والإجابات والمشورة أكثر من أي وقت مضى وعلينا أن نكون جاهزين ومستعدين لتقديم الدعم لهم”.

القادة القانونيون في منطقة الشرق الأوسط وشمال إفريقيا – نتائج رئيسية أخرى:

– يقول 43٪ من صناع القرار بالقطاع القانوني أن شركاتهم تخطط لزيادة الاستثمار المستقبلي في نمو هذه الشركات بينما 35٪ أخرين ثابتين على المستويات الحالية.

• أفريقيا هي الوجهة المفضلة عالميًا للاستثمار

– من بين صناع القرار بالقطاع القانوني الذين أجرينا معهم الاستطلاع والراغبين في الدخول إلى مناطق جغرافية جديدة، 81% منهم يتطلعون إلى توسيع عملياتهم في إفريقيا.

• التكنولوجيا والابتكار كدعائم للنمو

– 48٪ من صناع القرار بالقطاع القانوني الذين شملهم الاستطلاع زادوا من استثماراتهم في القدرات الرقمية في عام 2021 مقارنة بالعام السابق.

– يرى 69٪ أن ابتكار نموذج الأعمال أمر مهم، بينما يرى 39٪ من صناع القرار بالقطاع القانوني تبني منهج الابتكار في صميم عملهم.

• القطاع القانوني في دائرة الضوء

– أهم ثلاث قضايا تتعلق بالمخاطر والامتثال ذات الأولوية الملحة بالنسبة لصناع القرار بالقطاع القانوني في عام 2022 هي – المعايير المالية الجديدة والضرائب، والأنظمة المتغيرة ذات العلاقة بالملكية، والمعايير الجديدة الخاصة بالصحة ورفاه الموظفين/العمل.

Pakistan has urged the United Nations to promote universal accountability for grave human rights violations, especially in situation of foreign occupation in Kashmir and Palestine.

Addressing a virtual meeting on human rights violations, Deputy Permanent Representative of Pakistan to the UN, Ambassador Aamir Khan stressed that there should be no disparity between such violations in two different circumstances.

He noted that we should not forget the situations of Palestine and Jammu and Kashmir, where human rights are being trampled every day, and counter-terrorism laws are used to silence civil society.

The Pakistani envoy urged the international community to make pronouncements on violations of human rights in Jammu and Kashmir and in Palestine as well, just like they were making pronouncements elsewhere.

He said that the application of human rights in the Charter should be universal and impartial.

Pakistan and Saudi Arabia have agreed to strengthen cooperation in investment, industrial and mining sectors.

This was stated in a joint declaration at the conclusion of three-day official visit of Prime Minister Shehbaz Sharif to Saudi Arabia.

The two sides agreed to stimulate partnerships and enable investment integration opportunities between private sectors of the two countries.

They stressed the importance of strengthening work through the Saudi-Pakistani Supreme Coordination Council, for diversifying trade exchange between the two countries.

Saudi Arabia affirmed its continuous support to Pakistan and its economy, including augmenting the three-billion dollar deposit with the Central Bank through term extension or otherwise.

It also agreed to explore options to further enhance the financing of petroleum products and supporting the economic structural reforms for the benefit of Pakistan and its people.

The two sides also agreed to enhance media cooperation, explore opportunities to develop cooperation in the fields of radio, television and news agencies, and exchange experiences in order to develop the joint media work.

Saudi Arabia welcomed the statements of Pakistan mentioning keenness to find a solution to all disputes with India, including the Jammu and Kashmir dispute. The two sides stressed the importance of dialogue between Pakistan and India in order to resolve the issues between the two countries, especially the Jammu and Kashmir dispute, to ensure peace and stability in the region.

The two sides discussed the latest developments in Afghanistan, and agreed on the need to achieve security and stability, and to prevent the use of Afghan lands as a shelter for terrorist groups. The two sides also agreed on the importance of following up and implementing the outcomes of the extraordinary meeting of CFM OIC on Afghanistan, aimed at supporting stability and providing humanitarian support to the Afghan people.

They expressed their hope that the Russian and Ukrainian sides would reach a political solution that would end the crisis, achieve security and stability, and limit negative repercussions at the regional and international levels.

Pakistan and Saudi Arabia also discussed the developments of the Palestinian cause, and stressed the importance of preserving the status and the Islamic character of Al-Quds Al-Sharif in the Arab and Islamic nations, and achieving comprehensive and just peace in accordance with the relevant resolutions of international legitimacy and the Arab Peace Initiative, which guarantees the right of the Palestinian people to establish their independent state on the 1967 borders with East Jerusalem as its capital.

President Dr Arif Alvi has paid tribute to the working men and women who have made tremendous sacrifices and contributions to the socio-economic development of Pakistan.

In his message on the occasion of International Labour Day today, he said this day symbolizes the strength, character, talent and dedication of Pakistani workforce towards making our country a prosperous and progressive nation in the world.

He said Pakistan reiterates its commitment to provide an enabling environment and a higher standard of living for all workers and their families.

The President said Pakistan needs to focus on the skill development of its workforce so as to fully reap the dividends of emerging economic opportunities in the wake of increased regional integration.

Prime Minister Shehbaz Sharif says without the development of the workers, the real progress of the world is incomplete.

In his message on International Labour Day today, he paid tribute to labourers of Chicago whose sacrifices have become a global movement for labours’ rights.

He said the development of the world is the result of the hard work of the workers. The efforts of International Labour Organization for the health and safety of labourers are commendable and highly appropriate.

The Prime Minister said the labourers and workers which include educated, illiterate, skilled and unskilled play a pivotal role in the development of any country and society.

He said as soon as he took the charge, government raised the minimum wage to 25,000 rupees and will improve the working conditions of the workers in accordance with Islamic teachings, the constitution of Pakistan and international standards.

Shehbaz Sharif said Pakistan is committed to solving the problems of workers and labourers at all levels.

Chief Minister Balochistan Mir Abdul Quddus Bizenjo has said that laborers play an important role in the socio-economic development of any country.

In his message on the occasion of International Labour Day today he said the Provincial Government will ensure equal rights of opportunities and improve the living standard of workers.

He said the government is endeavoring to put polytechnic institutions on modern lines across the province.

The Chief Minister added that the provincial government believes in such labour policies which ensure protection of rights of all workers and laborers.

Governor Gilgit Baltistan Raja Jalal Hussain Maqpoon in his message said that without the hard work and courage of the workers the development of the country is not possible, the role of the workers in the development of any country would be very important.

Gilgit-Baltistan Chief Minister Khalid Khurshid in his message said on May 1 reminds us of the sacrifices, bravery and determination of the workers who upheld their basic rights and for a fair workingenvironment.
